Car accident - 18year old

My 18yr old nephew had a car accident, he crashed into a power pole - car is damaged, fence is broken, power pole is knocked down. Because he's 18, is he liable for damages? does he have to pay? His parents are divorced, he lives with his mum (my sister) but the car was his dad's. My nephew' dad wants my sister to pay half of all the damages, my sister thinks he should pay for his car and she'll pay the rest. The cost is mostly the car because it's a BMW. My nephew had a full license, wasn't drunk, but fell asleep on the wheel as it was early hours of the morning. Do you find this valuable?

Give us a call, there seems to be a few issues here.
The driver will be liable, the owner of the car is probably not going to be the issue, and there are issues around liability for damage to the power pole. Age is not going to be an issue either in terms of driver liability.
