Hi, I have been living away from home for a number of years now, however my mother has been withholding my income from me, which I earned whilst living with her between the ages of 16-20 years of age. I moved out of home just before turning 20 and was not given the income i had earned by my mother who had been holding on to it because i was told i had to save. Since moving out my relationship with her has deteriorated and I have asked her to return my savings so i can pay off my loan however she refuses to do so claiming the money earned by me was hers as she looked after me and it covered my 'expenses'. I disagree as she was on the benefit which supplemented her income for looking after me. Also between the ages of 18-19/20, she was also retaining both my income and my student allowance. Which covered more than my share of expenses and rent. I would like to know what my options are, i have asked her to return my savings as i don't want to be stuck with interest on top of my loan but she refuses to pay. Is there any possibility of me getting back my savings? I have proof in the form of IRD statements that I had earned that money and that i wasn't the one who had access to my bank accounts. (My mother opened bank accounts in my name and had access to them until i moved out, even when i was over 18).
Legal Issues: Am i entitled to the income i earned? What would be the next step for me to take?
i was advised to take this to the Tribunal, but noticed the following:
Types of disputes the Tribunal can't be used for You can't use the Disputes Tribunal for the following types of dispute: rates, taxes, social welfare benefits or ACC payments parenting or care of children matrimonial property wills ownership of land the value of goodwill with a business that is bought or sold trade secrets or other intellectual property such as copyright.

Hi,
I'm concerned about my children and the excessive amount of time they have off school, mainly for minor reason if any. My ex wife has day to day care of our children and when I have called to say goodnight on occasions my daughter has said she has had the day off school and when I've asked why it's often been because she was tired or even though other day I saw her and she was off school for a saw leg, but she was climbing a tree. Recently both my children were kept off school on the day I would normally Pick them up, because she decided they were staying with her and it was just to stop my children from being with me. I'm currently awaiting the children's attendance record but if it looks like they have been significantly absent then is there anything that I can do as I don't want my children to think they can just take days off school for no reason, and I don't want it to have a negative impact on their education either.

Speak with the school let them know of your concerns so that it can be noted. Ask if they have an attendance officer or an attendance service in your area. the school should be ringing to check why students are not at school each absence. But if you let them know you think mum may just be slacking they will question her a little more the next time they ring or if an attendance officer goes around to the house it might just give mum a wake up call

Hello,
I was asked to by my principal to sign out of school. Because I was admitted in hospital after this, I never really signed out but I was allowed to sit my exams..at another school. I would like to apply to another school this year but I need my two latest school reports, can the school decline my request to get my school reports?? Also, do schools do a background check on students about why they want to come to their school and not their current school and can they decline my application??

I was caught for shoplifting when I was 16 years old (Sep 2010). I have given a warning and it was my first time and last mistake ever. I am 17 years old nw and I'm really ashamed of myself and regret that I did last year I was only 16 years old and the police didn't charge me anything. It's been almost two years sicne I have been living in NewZealand and my family and I decided to get a permanent visa. However, the application asked me to write a criminal record and I was wondering if I have to write about this record, though I wasn't charged with money nor going court. I have only given the warning. I have a student visa at the moment and my parents has a working visa.

Well I'd say if you weren't charged or had to go to court and they have no record then you don't have to write it down. Usually the papers and other things ask about CHARGES. You were lucky to get away the way you did.

"im going to court for my first time for shoplifting, am i going to jail??" to l&p, for a first timer the court tends to offer diversion for small goods theft assuming there were not aggrivating or extenuating circumstances.

Hello,
It is a crime to lie on any immigration form and anyone who does so will be deported. If you are applying for a WHV, then NZ immigration will do a thorough search (including such things as attaining character references through police certificates) and so this information will become available to them.
If there is anymore specific information you require email info@youthlaw.co.nz, but please note that we are a community law centre and only cater to those under the age of 25 and fall under a certain income.
We wish you the best with your travels.

Hello,
If the school has your property then they are obliged to give it back, so maybe give the school a call beforehand to inform them you will be coming to get you your things. If this does not go well, perhaps give us a call here at YouthLaw to discuss the matter further. You can contact us on 0800 884 524.

Wearing a skirt with a slit all the way up the side on a national tv news program is not professional looking. Legal justification for an adult to assault a child as revenge for the assault of her own child? Bizarre all around... and highly unappealing. I certainly didn't need to see the details of Vanushi Walters's upper thigh blech.
