If you are on a periodic tenancy, you must give 21 days notice to the landlord that you are going to leave, unless your landlord agreed that you can give less notice. If you agree to one week or two weeks notice when you move in you should make sure this goes into your tenancy agreement. If you have to leave quickly because of an emergency or you have found a new tenant to take over your responsibility for the rent you should speak to the landlord and see if they will agree to you moving out earlier. If you paid a bond when you moved in you should ensure you get it back.

If you are on a fixed-term tenancy, you can only move out before the end date if the landlord agrees. Otherwise, you may be responsible for paying rent for the remainder of the fixed term.

To get your bond back, go to your Tenancy Services office and fill in the bond refund form. The landlord also signs this. The Bond Processing Centre will then refund the money. If the landlord won’t sign because they say you have damaged the property or haven’t paid your rent, go and see someone at Tenancy Services.

Does the tenancy aggrement exsit if only the landlord has signed the aggrement and not the tenants?
