What are 'goods and services'?This is a featured page

"Goods" are the things that you buy like a new CD player or a bag of lollies. "Services" are things done for you by other people like a bus ride or repairs to your car by a garage.

Problems with goods and services

If the problem with such a good or service can be fixed, you can ask the seller to fix it within a reasonable time [8].

If they don’t you can:

  • reject and return the good [9] and get a refund (or not pay what’s owed) or a replacement [10].
  • cancel the service and get a refund (or not pay what’s owed) [11].
  • or get it fixed somewhere else and get the seller to pay for the repairs [12]. (Make sure you get the repairer to write a note about the fault and the fixing of it).
If there is a major fault or it can’t be fixed, you can:
  • reject the good, return it and get a refund (or not pay what is owed) or agree to a replacement. Write down your reasons for rejecting the good, along with an explanation of what you want. Give this to the seller with copies of any paper work about the purchase. If you have bought the good on hire purchase, continue making payments or the good may be repossessed (seized).
  • cancel the service and get a refund (or not pay what is owed). Write down that you are cancelling the contract for service, along with the reasons for why you are doing so and what you would like to happen. Give this to the seller with copies of any paperwork relating to the service.
  • you can also elect to keep the good but ask for money to make up for the fault or you can ask for money for any extra loss you have suffered because of the problem (eg. the goods damaged something else of yours). [13]
If you’re not happy with the seller’s response, write to them saying what the problem is and what you want them to do within a certain time. Send it by registered post and keep a copy. If you still aren’t happy with their response you can make a complaint to the Disputes Tribunal if what you’re asking for is under $7500 (or $12000 with the seller’s agreement). If you are asking for less than $1000 it costs $30 to go to the Disputes Tribunal.
