Without Notice -If your situation is urgent, you can apply for a Protection Order, without the Respondent knowing that you are applying. A Temporary Protection Order can then be granted without delay.

To apply without notice you must show that:
  • any delay would result in harm or undue hardship to you or your child(ren). For example, that because of the abuse you are fearful of the Respondent's reaction to your application or fear for your or your child(ren)'s safety.
  • If you apply without notice the judge can grant you a temporary Protection Order which will last for 3 months. After that time the Respondent would have the chance to defend your having the order. You could then seek a permanent Protection Order without further application.
