How long does a custody order or guardianship order last?This is a featured page


A custody order continues until you reach the age of 17 years. It will finish earlier if:
  • the order is discharged by the Family Court;
  • you get married;
  • you are adopted by your foster parents or by someone else.[87]

A guardianship order continues until you reach the age of 20 years or earlier if the Court discharges the order or you get married or are adopted.[88]

These orders can be appealed or cancelled.

We have agreed that the above custody order under section 101[1]e be made in our favour but I am not exactly sure what it is - I know I can ring CYFS to find out and speak to social worker but haven't got that much time to hang on the phone.
