If an application is made to the Court and the Court is satisfied that a child or young person is in need of care or protection, the Court may make a declaration under s 67 of the Children, Young Persons and the Familes Act 1989 that the child or young person requires care or protection.

Upon declaration, the Court could place the child or young person in the custody of any of the following persons stated under section 101[1] a to e of the CYTF act. If you do not fall under any of the category from section 101[1] a to s 101[1] d, you would fall under s 101[1] e, under the "any other person" category.

However, under section 101[3], the Court could not place the child in the custody of any person unless the person consents to the making of the order.
