The law is not clear about whether you must wear a uniform to and from school, so it is not possible to answer this question definitely. A state or integrated school will not normally be able to do this, unless the Board of Trustees passes a rule to say you must. However, you may be able to challenge this rule if you think it is unfair. A Community Law Centre, YouthLaw or a private lawyer could give you more advice about this. A private school can make you wear a uniform to and from school if it is in the school rules. If you think this is unfair, it’s harder to challenge the rule but you can still get legal advice about this.

The law is not clear on whether you are in your parents' care going to and from school, if your parents don’t take you there. If a court decided you were, it would probably say it was your parents’ or caregivers’ decision how you dressed.

If your school provides transport or supervision (e.g. by running a school bus) to and from school, you would still be under the school’s care and expected to wear your uniform. If you left the school grounds during lunch hour it would depend whether you were under the school's or your parent's care (you are under your parents’ care if you are with them), and what the school rules said. Again, you may like to contact a Community Law Centre, YouthLaw or private lawyer to get some legal advice, because the law is not clear on this.
