Can I ask for a custody or guardianship order to be cancelled? This is a featured page

Yes - you or your lawyer can ask the Family Court to discharge (cancel) a custody order or guardianship order.[89] Your parents or a close relative can also apply. Before the Court will discharge the order, it must be satisfied that the order is no longer in your best interests. You should ask your lawyer (counsel for the child) for information about this.

[89] s125 & 126(1)(a) CYPF Act.
